Consent

1. Voluntary Participation and Scope of Activities

I, the undersigned participant, understand that membership in and attendance at events hosted by 50+ Monthly Mingle (operated independently by its ownership) involves participation in a variety of social, recreational, and physical activities. These activities include, but are not limited to: outdoor nature walks and trail hiking, active lawn games (e.g., bocce ball, cornhole), indoor tabletop games (e.g., Bunco, Mah-jongg, chess), physical dance lessons (e.g., Salsa, Country Western line dancing), culinary workshops, and general social gatherings. I acknowledge that my participation in any and all events is completely voluntary.

2. Assumption of Risk

I am fully aware that physical activities, outdoor excursions, and group social gatherings carry inherent risks of injury, illness, or property damage. These risks include, but are not limited to:

• Physical exertion, muscle strains, slips, trips, falls, or joint injuries during walks, hikes, or dance lessons.

• Environmental hazards during outdoor events, including uneven terrain, changing weather conditions, wildlife exposure, and sun exposure.

• Risks associated with traveling to, from, and between event locations.

I knowingly, freely, and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the releases or others, and assume full responsibility for my participation.

3. Health and Physical Condition

I certify that I am in good physical health and have no medical conditions, impairments, or illnesses that would prevent my safe participation in the events I choose to attend. I acknowledge that 50+ Monthly Mingleprovides lifestyle and social community tracking, and that any health or nutrition notes provided are for informational purposes only and do not constitute professional medical advice. I agree that it is my sole responsibility to consult with a physician prior to engaging in any new physical exercise or mobility tracks if necessary.

4. Release of Liability and Covenant Not to Sue

In consideration for being permitted to participate in 50+ Monthly Mingle events, I hereby release, waive, acquit, and forever discharge 50+ Monthly Mingle, its founder (Jennifer Wichard), its employees, volunteers, independent instructors, third-party venue partners (including but not limited to Tracey’s Real Estate Office, private restaurant partners, and local co-working or recreation spaces), and sponsors (collectively referred to as the “Releases”) from any and all liability, claims, demands, actions, or causes of action arising out of any injury, illness, death, or property loss/damage I may sustain while participating in, or traveling to and from, any club-sanctioned event.

5. Indemnification and Hold Harmless

I agree to indemnify, defend, and hold harmless the Releases from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in 50+ Monthly Mingle events, and to reimburse them for any such expenses incurred.

6. Photographic and Media Release

I hereby grant 50+ Monthly Mingle permission to use my likeness in a photograph, video, or other digital media captured during events in any of its publications, website portals, and social media promotions without payment or other consideration. I understand that if I wish to opt-out of media coverage, I must notify the event coordinator in writing prior to the start of the event.

7. Severability

I expressly agree that this waiver is intended to be as broad and inclusive as permitted by the laws of the State of Colorado. If any portion of this agreement is held to be invalid or unenforceable by a court of law, it is agreed that the balance shall continue in full legal force and effect.
